Biden Administration Agrees To Stop Selling Materials For Border Wall
In a significant victory for President-elect Donald Trump, the Biden administration announced it would cease the sale of materials originally designated for constructing the Southern border wall.
The decision, revealed on Friday, comes just weeks before Trump’s inauguration and follows a court order earlier this year requiring the administration to allocate statutorily obligated funds for border wall construction.
During Trump’s first term, efforts to build the wall faced opposition from Democrats and establishment Republicans. Now, buoyed by a voter mandate, Trump has prioritized completing the wall as a cornerstone of his agenda.
The Biden administration’s move was prompted by a petition from Texas Attorney General Ken Paxton, who sought a federal court review over reports of the materials being sold for “pennies on the dollar.”
“Attorney General Ken Paxton secured a victory for President-elect Donald Trump’s border-security agenda during a hearing today before a federal judge,” a press release from Paxton’s office stated. “The hearing was called at Attorney General Paxton’s request to uncover potential legal violations committed by the Biden Administration after recent reports that segments of the border wall were auctioned off for pennies on the dollar.”
The press release continued: “The Biden Administration confirmed to the court today that it will agree to an order preventing the outgoing administration from disposing of any further border wall materials over the next 30 days—allowing President Trump to use those materials as he sees fit. This will be adopted as an order of the court, making it enforceable if any violations occur.”
The court also mandated that the Biden administration provide documentation proving compliance with a prior injunction secured by Paxton in May 2024. That order required the administration to use funds for border wall construction after an attempt to redirect them was deemed illegal. If violations are uncovered, such as misrepresentations about the sale of border materials, officials could face contempt of court charges.
“We have successfully blocked the Biden Administration from disposing of any further border wall materials before President Trump takes office,” Paxton said.
“This follows our major victory forcing Biden to build the wall, and we will hold his Administration accountable for illegally subverting our Nation’s border security until their very last day in power, especially where their actions are clearly motivated by a desire to thwart President-elect Trump’s immigration agenda,” he added.
Trump’s legal team also filed an amicus brief in support of a case brought by Texas and Missouri to halt the sale of border wall materials immediately.
“The Court should issue an order directing the Defendants to immediately stop any ongoing sale of border-barrier materials to private parties pending the Court’s review of Defendant’s conduct,” the brief stated. It also urged a thorough examination of the administration’s actions to ensure compliance with federal law, the Constitution, and previous court rulings.
Reports from The Daily Wire had earlier revealed that the Biden administration had been selling the materials at a significant financial loss.
The president-elect’s brief criticized the sales as “deliberately selling off border-wall materials at a major financial loss to the Government to obstruct the pro-wall policy of Congress and President Trump. Such conduct likely constitutes a criminal act, such as a conspiracy to defraud the United States.”
“At the very least, the reported conduct raises troubling concerns of potentially criminal behavior,” the brief concluded.
