Democrat Lawyer Launches ‘Lawfare’ Plan To Prevent Trump Victory

If Donald Trump manages to defeat Vice President Kamala Harris in the Nov. 5 election, his next challenge may come in the courtroom, where her campaign attorney, Marc Elias, awaits.

According to Paul Sperry of RealClearInvestigations, the seasoned Democratic Party attorney has already filed over 60 lawsuits aimed at preventing Trump from reclaiming the presidency. These lawsuits focus on what Elias deems Republican “voter suppression” tactics, including requirements for voter ID at polling stations. In line with a common Democratic stance, Elias argues these measures are “racist” and designed to hinder minority voters from participating in the election.

“At the same time, Elias has been sending letters to election officials in Georgia and other swing states, threatening legal action if they continue efforts to clean up voter rolls by removing noncitizens and ineligible registrants,” Sperry notes. “Some officials in Georgia complain that his intimidation tactics are making it difficult for county registrars to verify voter qualifications."

“If Trump is declared the winner, Elias has threatened to challenge the results, deploying a legal team of over 75 lawyers to file recount lawsuits in key swing states,” Sperry adds. Trump, in turn, has threatened to imprison Elias for election interference, a point raised by ABC News moderator David Muir during last month’s presidential debate between Trump and Harris.

Elias symbolizes the increasing use of “lawfare” in U.S. elections, where both parties increasingly rely on the courts to secure an advantage, Sperry’s report explained. A Republican National Committee (RNC) memo reveals that the Trump campaign has already filed or participated in 123 election-related lawsuits across 26 states, with 82 of these in battleground regions, as they address alleged voter fraud.

In response, the Trump campaign has assembled thousands of lawyers to counter what one of Trump’s attorneys expects will be an “onslaught of litigation” from the Harris campaign over the election results. This legal team is also ready to demand recounts if Trump doesn’t win outright, according to the report.

Sperry continues:

Election experts point out that the GOP’s legal efforts, partly driven by Trump’s claim that the 2020 election was stolen, are playing catch-up. For years, Democrats have led the charge in using the courts to influence elections, and Marc Elias has been a key player. Behind his desk, Elias keeps a sign that reads: “BEWARE OF ATTACK DEMOCRAT.”

For many Democrats, Elias is seen as a hero. A 2022 New Yorker profile described him as “The First Defense Against Trump’s Assault on Democracy.”

However, conservatives have a very different view of him.

“Mr. Elias is part of a massive and well-funded partisan leftist operation notorious for using lawfare to undermine election integrity,” Judicial Watch President Tom Fitton told Sperry. “Making it easier to steal elections is the antithesis of ‘democracy.’”

In the meantime, Republicans are also preparing for the battle ahead.

RNC co-chair Lara Trump stated in an April interview that the organization has been stepping up its efforts for the upcoming election cycle, particularly by closely monitoring key polling centers from early voting through Election Day.

Speaking with Newsmax TV host Eric Bolling, Trump’s daughter-in-law remarked, “We all know 2020 wasn’t on the up and up.” Although she didn’t specify details, issues during the 2020 election were reported, such as when poll workers covered windows at a Detroit facility.

In any case, Lara Trump was speaking about ensuring that the RNC is just as prepared as the Democratic National Committee, with enough poll watchers and lawyers on hand to address any potential issues.

She also told Bolling that the RNC had recently secured a victory in an election integrity case in Pennsylvania and was involved in similar actions across the country.

Furthermore, Lara Trump stated that the RNC has 100,000 poll workers ready to “count how many ballots come in and how many ballots come out of every single polling location.” The organization is also prepared to take legal action against anyone suspected of “cheating.”
